Welcome to Lapentor! Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the website located at https://lapentor.com and any app-based web services, software, or tools provided by Lapentor (collectively, the “Service” or “Services”).
By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Description of Service
Lapentor provides an app-based web platform through which users can create, upload, edit, display, and host virtual tours from a set of panoramic images.
2. Accounts and Registration
To use certain features of the Service, you must register for an account. You agree to:
Provide accurate, current, and complete information during the registration process.
Maintain the security of your password and accept all risks of unauthorized access to your account.
Notify us immediately at [email protected] if you discover or suspect any security breaches related to the Service or your account.
3. Subscriptions, Billing, and Plan Limitations
Lapentor offers both Free and Premium (paid) subscription plans.
3.1 Premium Subscriptions
By subscribing to a Premium plan, you agree to the pricing, payment, and billing terms specified at the time of purchase. All financial transactions are securely processed through our third-party payment processor (Stripe). Lapentor does not store your credit card information.
3.2 Subscription Expiration and Downgrades
If your Premium subscription expires, is canceled, or is not renewed, your account will automatically revert to our Free plan. Upon this transition:
The Free plan allows a maximum of three (3) active projects.
Any projects exceeding the Free plan limit will be locked.
Locked projects cannot be accessed, edited, or published unless you upgrade to a Premium plan again. They will remain securely stored in your account, subject to our Inactivity Policy (Section 4).
4. Account Inactivity and Data Deletion Policy
To maintain a healthy digital ecosystem, ensure server security, and actively reduce our digital carbon footprint, Lapentor enforces a data retention policy regarding abandoned accounts and projects.
4.1 Inactivity Criteria
A project will be classified as an Inactive Project and become a candidate for permanent deletion if all of the following conditions are met simultaneously:
No Account Login: You have not logged into your Lapentor account for ninety (90) consecutive days.
No Project Edits: No modifications or edits have been made to the project for ninety (90) consecutive days.
Zero Views: The project has received zero (0) views in the last thirty (30) days.
4.2 Deletion Notice
Only completely abandoned projects meeting all three conditions above will be queued for deletion. Lapentor will attempt to notify you via your registered email address prior to taking any permanent action, giving you the opportunity to log in and keep your projects active. Once deleted, inactive projects and their data cannot be recovered.
5. User Content and Intellectual Property
Your Content: You retain all ownership rights, copyright, and intellectual property rights to the panoramic images, photos, comments, and other materials you upload or create using the Service (“User Content”).
Our Platform: The Lapentor platform, including its software, designs, logos, text, and graphics, is the exclusive property of Lapentor and is protected by copyright, trademark, and other laws.
Public Sharing: If you choose to make your virtual tours or User Content public, you understand that other users may be able to view, search, share, or embed your content.
6. Prohibited Conduct
You agree not to use Lapentor to:
Upload, post, or transmit any User Content that is unlawful, defamatory, obscene, invasive of privacy, or infringes on any intellectual property rights.
Exploit, harm, or attempt to exploit minors in any way.
Disrupt, interfere with, or attempt to gain unauthorized access to our servers, networks, or databases.
Use any automated systems (bots, spiders, scrapers) to access the Service without our written permission.
7. Termination
We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms of Service. Upon termination, your right to use the Service will cease immediately.
8. Limitation of Liability and Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. Lapentor makes no warranties, expressed or implied, regarding the reliability, availability, or accuracy of the platform.
To the maximum extent permitted by law, Lapentor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, resulting from your access to or inability to access the Service.
9. Changes to the Terms of Service
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice (such as via email or a platform notification) prior to the new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the updated Terms.
